Debt Collection In Nevada

The Federal Trade Commission recently released its “Top 10 Complaint Categories for 2012.”  The second most frequently occurring complaints received by the FTC were in regards to debt collection.  Specifically, the FTC received approximately 1,920 complaints from Nevada consumers regarding debt collection activities.  Importantly, these numbers from the FTC do not include lawsuits filed by consumers against debt collectors.  The report also found that Nevada consumers reported fraud and other complaints to the FTC at the 5th highest rate of any state in the country. (559.9 complaints per 100,000 residents).

While we are used to seeing Nevada at the bottom of state-by-state rankings for education, among others, we usually do not see Nevada at the top of any state-by-state lists.  Some would view this report as another negative ranking for the Silver State.  In reviewing this report, however, I am encouraged.  I am encouraged because Nevadans are standing up to debt collectors and reporting fraudulent actions.

Consumers, especially Nevadan consumers, in my biased opinion, should continue to report fraud and debt collection issues to the FTC.  Nevadans should also be aware of the Fair Debt Collection Practices Act and the protections it offers to consumers.
